New York | Courts green-light warrantless inspections of cannabis retailers ⚖️

New York's Third Department Appellate Division ruled that state and city officials can conduct warrantless administrative inspections of cannabis and hemp retailers, reversing a lower court injunction that had blocked them. Regulators argued — and the court agreed — that the Cannabis Law's licensing framework already provides enough constraints to satisfy the Fourth Amendment.

NORML case could be the key to blocking cannabis rescheduling ⚖️

Plaintiffs in the rescheduling lawsuit argue a prior NORML case requires the government to hold a formal rulemaking hearing and get HHS sign-off before moving a substance on the CSA, steps they say were skipped here. Attorney Michelle Bodian posted the filing on LinkedIn. The government has until July 2 to respond.
