"Much of what is marketed as homegrown cannabis is not grown in state at all. The practice, known as inversion, funnels cheap cannabis from oversupplied states into New York’s licensed market, where it is falsely sold as locally produced.” Damian Fagon, of the Parabola Center for Law & Policy said.
Fagon argued that state licensing schemes that allow over supply enable a vibrant illicit market in other states. Marijuana Moment ran his editorial about oversupply and the illicit market. Fagon was formerly the chief equity officer of the New York Office of Cannabis Management.

Spain legalizes medical cannabis 🇪🇸
Spain officially legalized medical cannabis this week. The new law will allow the country’s hospital system to prescribe medical cannabis to patients. It will be more restrictive than other countries, however, as cannabis will only be available in hospitals rather than regular pharmacies. The move comes days after the European Union developed a cannabis policy framework for member states.
New Michigan cannabis tax raises lawsuit 🏛️
Michigan’s Cannabis Industry Association (MiCIA) filed a lawsuit on October 7 challenging the state’s new 24% cannabis tax set to take effect in January. The suit claims the tax is unconstitutional because it did not pass with a three fourths vote in favor, which is required to change citizen-initiated statutes.
Germany restricts online medical cannabis sales 🚫
Germany’s government passed a plan on Wednesday to restrict online cannabis sales following a surge in imports in the first half of 2025 (up 400% from the same time frame last year). The change will require an in person prescription from a doctor and ban mail orders for individuals. German Health Minister Nina Warken says the move is to focus on getting cannabis to people who really need it, but others say it’s a push by Germany’s ruling coalition to crack down on cannabis — after Chancellor Friedrich Merz proposed rolling back legalization during the campaign last year. Ohio medical cannabis trending down 📉
From May 2024 to July 2025, Ohio saw a 43% decline in medical cannabis patients. The decline is likely due to Michigan’s prices having been cheaper at the time, and individuals not having to register for medical cannabis programs due to increased recreational use.

Terroir might be a thing for cannabis 🔍
Obsessing over the soil is no longer exclusive to wine snobs. A recent study published in the Journal of Medicinally Active Plants shows that where cannabis is planted has an impact on the development of terpenes and cannabinoids. This, in part, confirms anecdotal evidence from legacy growers across the country. Marijuana Moment has more.
